1Who these terms are between

These Terms of Service (the "Terms") are a contract between you and DEFTORIX TRADE LIMITED LIABILITY COMPANY, Aleja W Growska 2G, 07-130 Ochów, Poland ("we", "us"). They apply to the Appitra website and to the products Playloop, Vidora, Remota and Beamcast (the "Services"). By subscribing to or using a Service you accept these Terms, the Subscription & Refund Policy and the Privacy Policy, which form part of them.

If you are a consumer, nothing in these Terms limits the rights you have under the mandatory consumer protection laws of the country where you live.

2The Services

Each Service is a subscription product delivered over the internet:

• Playloop: a library of games played in a web browser.
• Vidora: a library of cooking, yoga and tutoring video lessons streamed on demand.
• Remota: an application that turns a phone into a remote control for compatible TVs and streaming devices on the same home network.
• Beamcast: an application that mirrors a phone screen or casts photos, videos and web pages to a compatible smart TV on the same home network.

Each Service has a free version supported by advertising and a Premium subscription that removes advertising and includes any Premium-only features described on the product page. The exact features of each Service are described on its product page and may evolve over time. Compatibility of Remota and Beamcast depends on your TV or streaming device and your network; we describe known limitations on the product pages and cannot guarantee compatibility with every device.

3Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, to subscribe. You are responsible for keeping your access details private and for activity under your subscription. Tell us promptly if you believe someone else is using it.

4Subscriptions, billing and cancellation

The free version of each Service costs nothing and shows advertising. Premium is sold as a recurring subscription paid by payment card. The plan, the price, the billing period and the currency are shown at checkout before you pay. The subscription renews automatically at the end of each period until you cancel. You can cancel at any time; Premium then continues until the end of the period already paid for, after which the Service returns to its free version. Payments are processed by Stripe. We may change prices for future periods; we will tell you by email at least 30 days before a price change takes effect, and you may cancel before it applies.

5Acceptable use

You agree not to: resell, sublicense or share access to a Service beyond your household; copy, download, record or redistribute games, videos or other content except as the Service itself allows; interfere with the operation or security of a Service; use a Service to control or cast to devices you are not authorised to use; or use a Service in a way that breaks the law. We may suspend or end a subscription that breaches these Terms, after notice where reasonable.

6Content and intellectual property

The Services, including software, games, videos, designs, text and trademarks, belong to us or to our licensors and are protected by copyright and other laws. Your subscription gives you a personal, non-exclusive, non-transferable licence to use the Service for private, non-commercial purposes while the subscription is active. Content cast or mirrored through Beamcast, and video lessons in Vidora, remain the property of their respective owners.

7Availability and changes

We aim to keep the Services available at all times but cannot promise uninterrupted access; maintenance, network problems and events outside our control may cause interruptions. We may add, change or withdraw features, and may retire a Service with at least 30 days' notice by email, in which case you will not be charged for periods after the retirement date.

8Warranties and liability

Where you are a consumer, we are responsible for providing the Services in conformity with the contract as required by law, and you have the statutory remedies that apply to digital content and digital services. Beyond those rights, and to the extent permitted by law, the Services are provided as described, and we are not liable for losses that were not foreseeable when you subscribed, for losses caused by your breach of these Terms, or for business losses. Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be excluded by law.

9Governing law and disputes

These Terms are governed by the laws of Poland. If you are a consumer living in another EU or EEA country you also enjoy the protection of the mandatory rules of that country, and you may bring a claim in the courts of that country. We will always try to resolve a complaint directly first: write to us and we will reply within 14 days, the period Polish consumer law sets for answering a consumer complaint.

10Changes to these Terms

We may update these Terms when the Services or the law change. We will give you at least 30 days' notice of material changes by email or by a notice in the Service. If you do not agree with a change you may cancel before it takes effect.
